PORTRAIT AGREEMENT + BOOKING FORM
AGREEMENT OVERVIEW: This Agreement expresses the full and complete agreement between the CLIENTS (Hereafter referred to as CLIENTS) and PHOTOGRAPHY BY PETRA SITH (Hereafter referred to as PETRA SITH) regarding the subject matter hereof. It supersedes all prior agreements. The only way to add or change this agreement is to do so in writing, signed by all parties.
COOPERATION: Unless otherwise noted, PETRA SITH will be the exclusive photographer(s) at this portrait photography shoot. The CLIENTS agree that good faith cooperation and communication between them is important in obtaining a good result.
IMAGES and COPYRIGHTS: Photographs/images produced by PETRA SITH are protected by Copyright Law (all rights reserved). Upon final payment by CLIENTS, are allowed to display resulting images for personal use. Said images may not be altered or reproduced in any manner without prior written permission of PETRA SITH. CLIENTS will receive a high resolution downloadable files with printing rights, prints or other media based on package purchased. When publishing the photos socially or commercially, www.petrasith.com or PHOTOGRAPHY BY PETRA SITH must be noted as the photographer. The CLIENTS must obtain written permission from PETRA SITH prior to the CLIENTS, their associates, friends or relatives selling the photographs.
PETRA SITH does not provide any RAW, or unedited images to CLIENTS.
MODEL RELEASE. The CLIENTS hereby grants to PETRA SITH and successors, heirs, executors, administrators, assigns, attorneys, representatives and agents, the irrevocable and unrestricted right to use and publish photographs of the CLIENTS or in which the CLIENTS may be included, for editorial, trade, advertising or any other purpose and in any manner or medium; to alter the same without restriction; and to copyright the same. The CLIENTS hereby release PETRA SITH and all associates representatives and assigns from any and all claims, actions, demands, suits, liabilities, damages, expenses, and obligations of any kind arising from, or related in any manner to PETRA SITH use of said images.
RETAINER & PAYMENT SCHEDULE: A non-refundable minimum fee of $150.00 is due at the signing of this agreement. (For full sessions, any mini-sessions or specials, balance due in full at time of booking. Deposit amounts can vary based on shoot and package.) This is a NON-REFUNDABLE RETAINER. Should CLIENT not show up to the scheduled appointment, cancel the appointment or otherwise breach this Agreement, the NON-REFUNDABLE RETAINER shall be liquidated for damages to PETRA SITH. The CLIENT shall also be responsible for payment of any materials/charges incurred up to the time of cancellation. Otherwise, the retainer shall be applied towards the Final Total, with the remainder of charges payable in full, prior to the photo shoot IF APPLICABLE. If extras are added on the day of the photo shoot, payments must be paid before final images are given to CLIENTS, approximately 1-4 weeks after the event.
LIMIT OF LIABILITY: In the unlikely event that the photographer(s) are injured, become too ill, or has an emergency that prevents them from photographing the event, PETRA SITH will contact the CLIENT as soon as possible, to arrange another suitable date and time. PETRA SITH takes the upmost care with respect to exposure, storage, and processing the photographs/images, but cannot and does not, guarantee that photographs/images of the event will not be lost, stolen, or destroyed for reasons within or beyond her control. CLIENT agrees that PETRA SITH or the photographer(s) full and complete responsibility and liability is limited to the return of all payments received for the event. I INDEMNIFY, HOLD HARMLESS, AND PROMISE NOT TO SUE the entities or persons mentioned in the above paragraph from any and all liabilities or claims made as a result of participation in this activity or event, whether caused by the negligence of such entities or persons or otherwise. I acknowledge that Photography by Petra Sith and their owners, directors, officers, employees, volunteers, representatives, insurance carrier, and agents are NOT responsible for the errors, omissions, acts, or failures to act of any party or entity conducting a specific event or activity on behalf of Photography by Petra Sith. I acknowledge that this activity or event may involve physical activity, and may carry with it the potential for death, serious injury, and property loss. I hereby consent to receive medical treatment, which may be deemed advisable in the event of injury, accident, and/or illness during this activity or event. I understand that at this event or related activities, I may be photographed. I acknowledge that flash may be used during this event or activity. I agree to allow my photo, video, or film likeness to be used for legitimate purpose by the event holders, producers, sponsors, organizers, and assigns. The accident waiver and release of liability shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law.
As of 06/01/2020 - Due to the current pandemic, client also recognizes the risk with any activity within this photo shoot and the possibility of being exposed to the COVID-19 virus, and understands that Petra Sith will do her best to follow guidelines to maintain safe distance and wear a mask, as well as the safest chosen location, but that the risk cannot be completely eliminated. Client / Clients also have the option of rescheduling any photo session if needed, and will notify Petra Sith if they or any subject that is a part of said photo session are ill, plans can be made to change the session to a future date and time.
COMPLETION SCHEDULE: Images are expected to be edited within 1-4 weeks after the photo shoot date. Prints/canvases/frames and extras will be available anywhere from 2-6 weeks, after they are ordered.
